Overview
The Servicemembers Civil Relief Act (SCRA) is a federal law that provides certain financial benefits and protections to eligible active-duty military personnel. The purpose of the SCRA is to strengthen and expedite national defense by giving servicemembers certain protections. These protections enable servicemembers to devote their entire energy to the defense needs of the nation. At Chrysler Capital (CC), we are proud to provide our servicemembers with a SCRA program that goes beyond the minimum requirements.
What are some of the benefits of the Chrysler Capital SCRA program upon approval?
- A maximum 6% interest rate for the life of the loan.
- Forgiveness of interest in excess of 6%.
- Protection from repossession during a period of qualifying military service.
- The option to terminate a motor vehicle lease before the scheduled lease end date without incurring an early termination fee (Note: Any taxes, summonses, or other obligations and liabilities of the lessee in accordance with the terms of the lease that are due and unpaid at the time of the termination shall be paid by the lessee).
- Lease amounts that are unpaid for the period preceding the effective date of the lease termination shall be paid on a prorated basis.
- Active duty servicemembers of the Army, Navy, Air Force, Marine Corps, Space Force or Coast Guard.
- Members of the National Guard under a call to active service authorized by the president or the secretary of defense for a period of more than 30 consecutive days under section 502(f) of title 32 for purposes of responding to a national emergency declared by the president and supported by federal funds.
- Members of the Reserves and servicemembers ordered to report for draft induction.
- Commissioned officers of the Public Health Service or the National Oceanic and Atmospheric Administration in active service.
- U.S. citizens serving with Allied Forces.
- Co-borrower of an eligible servicemember.
- Dependents (must first request/apply to a court). CC may choose to extend benefits to non-borrower dependents.
- The active duty start date must be after the loan inception/date of contract (e.g. contract date is June 20, 2017 and the servicemember goes into active duty September 3, 2020, qualifying the servicemember for the interest rate cap and repossession benefits if all other requirements are met).
- The request for benefits must be made no later than 180 days after the date of a servicemember’s termination or release from military service.
- Documentation is available to support the military service and active duty period. The following are examples of acceptable documents that meet the requirement:
- Military orders calling the servicemember to military service and/or any orders further extending military service.
- Any other appropriate indicator of military service, including a letter from a commanding officer.
- CC may rely on information obtained through the DMDC.
- To be eligible for repossession protection, a deposit or installment payment must have been paid by the servicemember before the servicemember enters military service (active duty).
- Members of the Reserves and servicemembers ordered to report for induction.
- Commissioned officers of the Public Health Service or the National Oceanic and Atmospheric Administration in active service.
- U.S. citizens serving with Allied Forces.
- Foreign Service Officers.
- Co-borrower of an eligible servicemember.
- Servicemember dependents (spouse, child, and dependent) for whom the servicemember provided more than one-half of the individual’s support for 180 days immediately preceding an application for SCRA relief. It is not required for the servicemember to be named on the lease (co-borrower) for CC to extend the ELT benefit.
- If the lease was executed prior to start of military service (active duty after the contract): A servicemember is entitled to the right to terminate a motor vehicle lease provided that the lease was executed by or on behalf of the person who thereafter and during the term of the lease enters qualifying military service:
- The lessee enters a period of military service under a call or order specifying a period of not less than 180 days, or
- The lessee enters military service under a call or order specifying a period of 180 days or less and who, without a break in service, receives orders extending the period of SCRA-protected military service to a period of not less than 180 days.
- If the lease was executed during military service (active duty prior to the contract): A servicemember is entitled to the right to terminate a motor vehicle lease provided that while in qualifying military service the servicemember executes the lease and thereafter receives military orders:
- For a permanent change of station regardless of the distance from the servicemember’s prior duty station.
- Permanent change of station includes separation or retirement from military service.
- To deploy with a military unit or as an individual in support of a military operation for a period of not less than 90 days.
- If while in military service the servicemember executes a lease upon receipt of military orders, and thereafter receives a Stop Movement order issued by the secretary of defense in response to a local, national or global emergency for a period of 30 or more days, which prevents the servicemember or the servicemember’s dependents from using the vehicle for personal or business transportation.
- Upon the death of lessee: A spouse or dependent of a servicemember lessee is provided with the right to terminate a lease if the lessee dies while in military service or while performing full-time National Guard duty, active Guard and Reserve duty, or inactive-duty training.
- Upon catastrophic injury or illness lease termination: A spouse of a servicemember lessee is provided with the right to terminate a lease if the lessee incurs a catastrophic injury or illness during a period of military service or while performing full-time National Guard duty, active Guard and Reserve duty, or inactive-duty training. In the case of a lessee who lacks the mental capacity to contract or to manage his or her own affairs due to such injury or illness, the spouse or dependent of the lessee may terminate the lease.
- A written request must be received in order to be reviewed for the Early Lease Termination option.
Note: Timely payments are still required to be made on accounts protected under SCRA benefits. We may report information about your account to credit bureaus. Late payments, missed payments or other defaults on your account may be reflected in your credit report.
